This is a timely reprint of an article posted on savescientology.com. — Thoughtful

WHAT LRH ORDERED:  In the early 1980s, prior to his departure, L. Ron Hubbard re-organized the corporate structure of Scientology and ordered the new structure to be implemented.  The newly-created governing bodies of Scientology became three California nonprofit religious corporations (i.e, CST, RTC & CSI) with seven separate boards of trustees, general directors and, for CST only, a third board of special directors.  See: LRH Intent.

WHAT WAS DONE:  The corporate structure has been followed in form only, never in substance.  In reality, all the boards of general directors and trustees corporate boards are captive and under the control of one man: David Miscavige.  That all organizations and aspects of Scientology is subject to one-man rule by Miscavige is one of those facts universally known to all Scientologists, but which, as with the policy of disconnection, the Church publicly denies.

As stated in PR Series No. 2, one should “NEVER USE LIES IN PR... All lies will dead end some day.”

These lies appear destined to dead end in a Texas courtroom.  There, the corporate veils of the governing bodies of Scientology are being lifted to expose David Miscavige to personal liability for the alleged harmful actions done under his one-man rule.  It is a fine mess he finds himself in; one that he created and could have avoided; and one that still has a solution.

The Texas Legal Case

In a nutshell, Monique Rathbun, the wife of Marty Rathbun sued the three governing church corporations (CSI, RTC and CST) as well as David Miscavige, personally, and a few other individuals, claiming that she was harassed, put under constant surveillance, falsely accused of really being a man who had a sex change, and embarrassed at work (a dildo mailed to her, and flowers sent to a female co-worker in Monique’s name).

A Texas court issued a temporary restraining order (TRO) against all defendants, and set the case for hearing on a preliminary injunction.  A TRO, as the name implies, is temporary.  It lasts only until an evidentiary hearing can determine whether the order should be extended until a full trial of the case can be held to determine whether a permanent injunction should be issued.

The hearing on preliminary injunction was set for Thursday and Friday, September 12th and 13th.   Two other matters were squeezed onto the hearing calendar.

One, defendants David Miscavige and RTC made a “special appearance” through a motion contesting the court’s jurisdiction over them.  And two, the Church (CSI), which had accepted jurisdiction in Texas, sought to to disqualify Monique’s lawyers on the grounds that they had been tainted by receipt of privileged information from Marty, a witness in the case.

The judge heard partial argument and testimony on all three matters, but resolved none of them due to a lack of time, and continued the hearing until October 18, 2013.

However, based on the Judge’s comments during arguments, and his order that both RTC and CSI make corporate representatives available for deposition in the meantime, Miscavige and his legal case, are in big trouble.

Piercing the Scientology Corporate Veils

Counsel for Miscavige and RTC claimed, essentially, that they were not connected to the alleged wrongdoing, that any harm later proven to have occurred to Monique was the  responsibility of CSI, not RTC or Miscavige.  That position was severely undermined, however, by Marty Rathbun’s affidavit on the inner workings of RTC.  Marty details, for example, how Miscavige micro-managed OSA (Office of Special Affairs) by using Marty as secret go-between Miscavige and Mike Rinder, the head of OSA International.  This is highly improper because OSA Int is a department (Dept. 20, Div 7) of CSI, a separate corporation from RTC.

The legal significance of this aspect of Monique’s case is huge.  All Scientologists should take careful note of it in order to appreciate what is at stake.  Certainly, all future litigants against the Church will.

First, a little legal primer.  There are two major benefits afforded nonprofit corporations: (1) tax exempt status and (2) protection from personal liability of its officers, directors, and members.  In order to qualify for these benefits, corporate formalities, including independent boards of directors, must be followed.

Therefore, if Monique Rathbun can substantiate Marty’s testimony, she can “pierce the corporate veils” and expose David Miscavige, and potentially other directors and officers, to personal liability.  A court ruling, and/or the evidence upon which it is based, could also form the basis of a revocation of tax exempt status action.

(In 1967, the IRS revoked tax exempt status for the California Church of Scientology due to lack of corporate board oversight.  The California C of S was the-then “mother church” of Scientology and  predecessor to CSI, the current “mother church.”  The 1972 revocation of tax exempt status led to the “war” with the IRS and the corporate re-structure to remedy that loss of tax exempt status.  Regaining tax exempt status was the primary purpose of the re-organization and was such a high priority to LRH that he created a board of special directors in CST who had the sole duty to not only obtain tax exempt status, but to maintain it.)

Therefore, Miscavige, by his failure to carry out LRH Intent to end one-man rule upon his death and govern Scientology through multiple checks and balances among seven (7) boards of trustees and directors in three (3) separate nonprofit religious corporations, and by his refusal to put the interests of Scientology above his own personal interests, has put at risk Scientology’s tax exempt status in addition to creating the legal and PR quagmire in which Scientology finds itself engulfed, and into which it is sinking ever deeper over the last four years.  Attacking whistleblowers never works, as we have written; only internal, independent investigations solve the problem of alleged corporate corruption.

Protecting Orthodoxy

On day one of the hearing, CSI’s attorney admitted that the Church surveilled the Rathbuns because they were challenging Scientology’s orthodoxy, by which he meant that Marty was violating the trademarks of Scientology by practicing the religion outside the Church.

A person trained in Scientology “grades” technology (i.e., a Class IV auditor or above) will recognize this statement to be a justification for wrongdoing.  In an auditing session, the next question from the auditor would be, “How else did you justify that overt?”

A person trained in the law will recognize the Church’s actions to be vigilantism, or taking the law into one’s own hands in bypass of the legal system in an attempt to effect justice according to one’s own consideration of right and wrong.

For, if it is true that Marty violated Scientology’s trademarks, there is a legal remedy: a lawsuit for trademark violation under the Lanham Act (also known as the Trademark Act).

LRH gave to RTC the Scientology trademarks and the express duty to protect them.   David Miscavige is the head of RTC.  So why was this simple – and lawful – solution not taken?
Why did (allegedly) David Miscavige resort to sending a dildo in the mail to Monique’s place of employment and engage in other distasteful and legally actionable conduct, instead?

Under the Lanham Act, RTC had three years to file a lawsuit against Marty Rathbun and any other Scientologist who was violating Scientology’s “orthodoxy.”  Because Marty set up shop in June 2009, the statute of limitations has expired.  RTC is now forever barred from bringing a trademark suit.  Arguably, the trademarks of Scientology have become part of the public domain, meaning that Miscavige may have lost the trademarks of Scientology rather than protect them, as he was charged to do.

(By the way, the other rights given to RTC by LRH were Scientology’s trade secrets, in other words, the Upper Levels.  In 1983 these were stolen from the Advanced Organization and Saint Hill Organization combined for Europe and Africa (AOSH EU & AF) by a group of former Sea Org members, and the materials were subsequently leaked on the Internet.  RTC lost these trade secrets; they are part of the public domain.  This means that RTC completely failed its mission and has no purpose for it continued existence.  For those Scientologists who still measure a staff member’s value based on production and results, rather than on PR or personality, this colossal failure should be telling.)

The answers to the questions raised above are obvious.  First, RTC could not win a trademark violation suit.  A person (or organization) suing for trademark violation must come into court with clean hands.  Proof of wrongdoing on the part of the plaintiff is a complete defense.  And Marty Rathbun, and other former high-ranking Sea Org members at Int Base, claimed that they were only practicing Scientology outside the Church because Miscavige had made life unbearable inside the Church for them: he created a culture of violence and personally beat staff in addition to inflicting them with other cruel and inhumane treatment that no person, even a Sea Org member, should have to endure.  See, e.g.: Truth Rundown & Debbie Cook Testimony.

We are mindful that these are allegations, and that the Church has strongly refuted them.  But, three points: (1) avoidance of a lawful solution is, like the flight of a criminal, evidence of guilt, and (2) this is not how one handles allegations of corporate corruption, as we have written on this blog: one investigates the claims of whistle blowers; one does not attack the whistle blowers; see point (1); and (3) allegations versus counter allegations do not resolve; like a problem of intention versus counter intention, they persist.

The second answer to the questions raised above is also obvious.  Miscavige placed his personal interests – his position as supreme ruler of Scientology – over those of RTC, the aims of Scientology, and the wishes of LRH.

Solution

Here is the solution:

    1.  Implement the corporate checks and balances as previously established by LRH; that is, empower the boards of trustees and directors;

    2.  Miscavige step aside pending internal investigations conducted by the boards in conjunction with reputable audit firms and independent of David Miscavige and any subordinates who are implicated in the allegations made by former, long-term senior Sea Org executives;

    3.  Make public the findings and all corrective actions taken to ensure that any wrongdoing does not recur; and

    4.  Abolish the policies of disconnection, fair game and security checks by reissue of the Reform Code of Scientology.  Hear Ron define it in RJ ‘68: Click here; See also: “Reform Code of Scientology” in the Modern Management Technology Defined, First Ed., p. 440.

The first step will bring Scientology into compliance with California law for nonprofit religious corporations and IRS rules and regulations on tax exempt status.  Until this step is taken, tax exempt status is at risk.  Probably the only reason that the IRS has not yet commenced a revocation hearing is due to a moratorium on revocation hearings pending the appointment of a high enough official within the IRS to authorize such proceedings.

The second and third steps are part of what is often referred to as the American Corporate Protocol for handing allegations of corporate corruption.  The protocol evolved through the failure of attacks against whistle blowers and the success of internal investigation, independently conducted (so as to give the investigations and their findings credibility).

In 1968, LRH canceled the polices set forth in step 4 in response to broad public surveys which revealed the general public hated them.  As practiced by the Miscavige Administration, these toxic policies are used as control mechanisms that the general public identify with cults.  So, naturally, use of the policies define the us to be a cult, which damages our communication line to the general public and impedes the aims of Scientology.

Board members of CSI, RTC, and CST (in particular), are requested to consider their actions, and failures to act, in light of their legal and Scientological responsibilities.  They can, and we believe, they should, take action.  They can contact us.  We have specialized law firms on retainer and the resources to help you carry out your duties to solve the situation.  We will treat your communications in absolute confidence.

Failure to Solve

The future is easy to predict if the situation is not solved.  Just review the events since June 2009.  Ever-increasing negative publicity, ever-decreasing public credibility.  Ever-increasing independent field, ever-decreasing membership.  Media are more emboldened to criticize the Church.  Publishers have identified a market for books on Scientology.  Filmmakers, too.  Lawyers have fine-tuned law suits to pierce Scientology’s corporate veils; a formula for success has been developed; there will be more.  One can foresee major legal actions attacking Miscavige and his control mechanisms.  The IRS will seek revocation of tax exempt status.  All this looms on the horizon.

All this can be reversed.  This is good news – for every Scientologist not named David Miscavige or a facilitator therefor.

Meet Monty Drake, Electronic Peeping Tom

Snap shots posted on the web of PI, Monty Drake.

After three years of continual harassment, it’s payback time. Church of Scientology mob boss and Chief Stalker In Charge, David Miscavige, is about to cash in his chips at the First Bank of Karma. The friendly teller behind the bullet proof glass? None other than Monique Rathbun.

Subjected to a litany of dirty tricks and vile attacks orchestrated by and emanating from Church of Scientology leader David Miscavige, Monique has filed a multimillion dollar lawsuit against CoS controlling entities, Miscavige, and also two private (sleaze bag) detectives, each with less backbone than an amoeba—Granbury, Texas private investigator Monty Drake, and Steven Gregory Sloat.

drake-rathbun-homes

Creepy King, Monty Drake

Monty Drake leased the previous home near Monique and Marty in Ingleside, TX, aiming a motorized telescopic spy camera right into her living room and a bedroom window and then lied about who he was and what he was doing to Monique’s husband. Monty Drake says on his website that he “wants liars, cheaters, thieves and perpetrators of fraud!” Well it seems like he need only go as far as the nearest mirror and he could find exactly what he’s looking for. Apparently he has been a go-to man-whore for David Miscavige since the 1980s.

monty-drake

Still from Monty Drake's private detective website featuring a
shooter game where a woman gets her clothes
torn off by a predator to reveal her breasts.

Scientology-cult.com already noted that previous private detectives/harassers hired by David Miscavige and Co. were felons. What kind of person is Monty Drake? Well, good question. Monty Drake has a cartoon shooter game on his private detective website where you can look into a bedroom window in an old western town… and what do you know? A woman’s dress is being torn off to reveal her breasts. Wow! Why don’t most people have a game like that on their professional website? Maybe because they aren’t secret pervs and professional Peeping Toms? Why would a private detective have a shooter game on their website?

It is ironic that in real life Monty Drake not only lives in Granbury, Texas next to a sewage treatment plant, but he did point his telescopic spy camera into Monique’s actual windows… for something like two years. Is this a professional private detective that secretly gets off by leering into women’s bedrooms? Or is this a professional pervert with the ideal career to cover private ambitions as a peeping Tom? Either way the whole thing stinks and it’s not because of the sewage treatment plant.

Steven Gregory Sloat who’s recent arrival on the undeveloped property next door to Rathbun’s new digs in a secluded wood in the San Antonio suburbs (where they moved, specifically, to get away from David Miscavige electronic spy stalking) also lied about what he was up to. Then pretended the surveillance cameras that went up over night were there to monitor Texas wildlife… the only problem was that all his cameras were into pointing to Monique’s home. Again.

These two jokers are also lining up behind Miscavige at the pay window, chips in hand.

surveillance-house

Monique’s suite holds CoS representatives responsible for,

• Showing up at her home to question her while her husband is away.
• Setting up hidden surveillance cameras on the couple's homes.
• Sending a sex toy to her at work (a huge dildo) and flowers to a female co-worker with a romantic note purportedly from Rathbun.
• Following and videotaping her as she ran errands, went out to eat or took evening walks.
• Questioning her parents, co-workers and friends.
• And posting "vile allegations" on websites tied to the church.

The question is what kind of person hires thugs to stalk and harass a women? How is it that the leader of a religion could be doing this and getting away with it for so many years?

monty-drake-sewer-neighbor

I noticed that Monty Drake tries to keep a low profile online. That doesn't seem right since he's a professional electronic STALKER.

How to stop the Church of Scientology from stalking you, harrassing you with incessent junk mail, and endless telephone calls for money.

Over the years, thousands of people have practically torn their hair out because it is nearly impossible to get the Church of Scientology to stop incessent mail and telephone calls. Turns out, the problem is not that hard to solve.

Note, Vitina Marcus was not even a Scientologist. She was an actress who appeared in an amazing number of films and many of the most popular TV shows of '50s and '60s. But she had the courage to stand up to the CoS and she figured out how to stop the harrassment. And for that, she is warmly thanked, because her example serves as an example to many. David Miscavige caught red-handed by Anonymous PDF  | Print |  E-mail

anonymous logoThey have always said they "will be watching" and sure enough they were.

When Lucas Catton, former Executive Director of Narconon, spoke out in this week's edition if Rock Center on NBC, the Church of Scientology retaliated in their usual psycho-killer-on-bath-salts way by quickly getting up a hate site (www.lucascatton.org) to defame Lucas Catton. Only in the rush to get the site online, they forgot a couple of important details and David Miscavige promptly got caught, as the Dead Boys said, "with the meat in his mouth."

Yes, Miscavige flunkies apparetly left a second live domain pointing to the same website: www.free2believe.org

While the OSA worms remembered to cloak ownership of their new hate website in the WhoIs database, they forgot to change www.free2believe.org which was had been listed since April 2005 as belonging to the Church of Scientology.

The bust was made by DeathHamster, an active member of Anonymous since 2008. Results were posted WhyWeProtest.net (click to visit).

As you can see in the screen shot below (posted April 5, 2013 at 1:17 PM), the address for the website was listed as 6331 Hollywood Boulvard which is the Hollywood Guarantee Building — home to OSA International.

Of course the CoS jumped on this to hide the connection as per usual and so the free2believe.org no longer points to the Lucas Catton website.

So that not only shows David Miscavige's massively corrupt Church of Scientology is directly behind a global consipracy of cyberstalking involving efforts to incite hate and defame whilstleblowers, but since they were caught retaliating against a Narconon whistleblower, Miscavige's goon squad has thoroughly incriminated themselves as complicit in the "Narconon" deaths and abuses which are the whole point of the whistleblowers.

Thanks to DeathHamster and Anonymous for a successful investigation.

Whistle-Blowers - Thoughtful

by Thoughtful

Of all the articles I’ve ever written, this one might go down in history as the one most damaging to David Miscavige.

How is it, that despite the fact that Scientologists “have the tech on the suppressive person” everyone, and I mean everyone, missed David Miscavige for so long, the most flagrant SP in the history of Scientology, a classic SP in every sense?

The great liability of knowing you "have the tech" is assuming it is complete when it isn’t. And for the Church it was a fatal flaw.

There is an incredible HCO PL in OEC Vol 0. Few Scientologists know about it, but it is called TECH. It’s purpose is not to provide background theory, but effective tools you were intended to apply.

As LRH explains, any tech has its product. But the only way to know if a particular technology is correct is by looking at the product. If the end result is confusion he says, then you have incorrect or incomplete tech. Incorrect tech would include false data.

Now consider the PTS/SP tech. The state of the Church, tells us something important. DM even pushes people to study the PTS/SP tech. But still they don’t spot him.

So the question arises, if LRH’s PTS/SP tech was complete wouldn’t the Charlatan of the Board, David Miscavige, have been detected earlier?

Thankfully a brilliant individual — has filled in some missing blanks and brought to a finer point the vital work that LRH pioneered on the detection of the SP. She wrote a book. I’m slightly frustrated to say it was published in 2005 — frustrated, because I wish I read it years ago.

How important is this book? If we could all read only one book in our lives, this one would get my vote. It ought to be read to first graders and re-read every year until a person is 100 years old. I think more than any other book I’ve read, it could do more to help people deal with the real problems of life than any other. I will explain why in a moment.

But first, let me say this book will empower you against the true sources of friction and betrayal that confront us. LRH said it was 2.5% of the population. She, in many ways, defines the SP even more accurately than LRH did and her studies indicate that their percentage in the population varies by culture. In the US and western Europe the actual number is at 4% (and rising). In China and Japan the count is much lower — ranging from 0.03% to 0.14%.

But what is so amazing is her definition of the sociopath, and her breakthrough on how to detect them.

One further nail in the coffin for the Church is who wrote this book. A psychologist; a psychologist who is indeed worthy of the name. She has done what probably no one else could do — journeyed into the heart of darkness and returned with the holy grail. For when one considers the bumps in the road of life, those bumps are not caused by the sane 96%. These sociopaths are inevitably the source of disasters and catastrophes in life.

The book is called The Sociopath Next Door and its author is Martha Stout. (Kindle version)

You will laugh to see what she says about the suppressive person because what she says syncs so well with what LRH discovered. But she doesn’t just repeat his observations. She goes further and in a way, deeper. You will blow charge and major shifts will occur in your world. LRH stated it is therapeutic to get educated on the subject of SPs — it nullifies their destructive influence to a great extent.

Now, she doesn’t know everything LRH discovered. Her book does not replace what LRH wrote. The two bodies of work complete each other like two halves of a jigsaw puzzle.

Having read her book it is easy to see in LRH’s writings when he had encountered the sociopath or “suppressive person” because he starts to describe the personality several times. You see bits and pieces showing up here and there early on.

LRH described some traits of the sociopath when talking about people in the tone level of covert hostility. And certainly a sociopath can be 1.1. But his victims can also be in that tone band. Tone level is not a dependable indicator.

When you read her description, you are going to laugh also because everything she says is so perfectly a description of David Miscavige, from cradle to present time, along with other sociopaths you have known. They aren’t all driven to be movers and shakers, but some are. She explores all their various types and really gives you a FULL education on the subject so you can detect and get them out of your life.

Confusion

Scientology alone does not give the clearest picture of the sociopathic, antisocial or suppressive personality. LRH basically discovered there were indeed two distinct personality types. But then he and others engaged in labeling people as “antisocial personalities” if they violated certain justice codes. What that did (theoretically, anyway) is create a vast number of new criteria for determining who and what constitutes an “antisocial personality.”

For example, did you know that at one point LRH wrote in an HCOPL anyone who blows from course should be declared an SP? In other words, there are the 12 characteristics of an antisocial personality plus 12 characteristics of a social personality which together was at one time, “The Test.” Then later, there came a list of high crimes which apparently if you violated them, rendered the test irrelevant.

I found myself blown from a course once in about 1981. The Tech Sec, Austin Day Org, Vicky White, simply called me up and asked me what my MU was and like a neon light the word “that” appeared in front of me. After I cleared up the definitions, I wanted to go right back on course and I did. Well, per that Policy Letter, I could have been declared instead.

Calling someone a squirrel or an antisocial personality when they are not is a falsehood and possibly a control method that produced CONFUSION and opened the door to the present disaster. That's a theory.

LRH made a monumental discovery — there were two types of personalities — as different as night and day. And then he failed to stick by his own definitions, a huge mistake.

The problem with an unclear definition is that it can then be abused — and it has been. How stupid is it to let an SP inside the church drive all the good people out, and then as each one goes, he or she is labeled an “SP” by the actual SP who is driving them out?

Even if a person commited one of Scientonlogy's "High Crimes" (which is really a moral code, not "ethics"), that only proves he has committed a High Crime. It does not prove he is in fact an “antisocial personality.”  Read the book and you will know why.

So this book will take us to a place where anyone can clearly discern a genuine sociopath for what they are.

Martha Stout has greatly contributed to the work that LRH began — she has identified the SP using criteria that are truly original. Sociopaths (SPs) currently number 4% in the US as I mentioned which puts social personalities at 96%.

No doubt there are professions and positions that attract such personality types. Its not the profession that is the target, it is the individual sociopaths who victimize people.

Among social personalities however there are also several problem personality types who are sources of trouble. These now become far easier to understand because between LRH and Martha Stout you have enough essential stable data that you can avoid confusion.

So all in all, what Martha Stout’s book is and what it means for civilization is truly landmark. This book is a game changer, not just for us, but for the world. I hope others read it. I think if enough Indies read this book, what’s left of DM’s world will crumple in on him.

Marty put this book on his essential reading list. Yes, yes, yes! If everyone in the Church was gotten to read this book, many would spot DM. For those who have left, it is definitely a critical route to closure.

Per LRH, and he was the pioneer on the subject, the handling for the SP is in three stages: detection, routing and handling. Scientologists have been unable to detect the sociopathic personality because they didn't fully understand what it was — the definition was confused. So the handling steps bugged at detection.

With what we know in Scientology about the SP, The Sociopath Next Door is going to complete the job of making you unassailable. Like Scientology itself, it contains a discovery people have been searching for across millennia. It IS the holy grail.

We say in Dianetics that the problem is the reactive mind. Then later LRH discovered the core of the reactive mind was the R6 bank — a super complex pattern of opposed goals and masses implanted eons ago, which is audited out on the Clearing Course or New Era Dianetics. Who was responsible for creating that implant? Sociopaths.

So when I say if you had only one book to read in your lifetime, this might be the most beneficial of them all — I’m not kidding.

I'm so excited to think about what will happen when you read this book. It is going to empower you like nothing else. It is that amazing.
